94 Wines B.V. (hereinafter “94 Wines”) respects your privacy. We recognize your demand for a reliable control of your personal information known by 94 Wines and we will always treat your information confidentially. Among other things we achieve this by abiding strictly to legal regulations with regard to the protection of personal data. Furthermore, we think it is important to keep you informed of the way in which your data is processed. At any time you can access, change or remove your personal data processed by us.

1. Use of personal data by 94 Wines
1.1 To register as a Member of the 94 Wines website you need to make a 94 Wines account. For that purpose 94 Wines will ask you some information. This involves your name, age, sex, address, place of residence, delivery address and E-mail or the details of a current account, like Face book, Hyves. At the Website only your first name, last name, gender and place of residence will be visible, unless you indicate that you wish to show more details to your friends. It is also possible to choose not to show any details on the Website.
1.2 When you register for an account at 94 Wines, we will store these details at a Secure Server. In your 94 Wines account, we store data like your name and address, phone number, email address, delivery address, so you do not have to fill out these details with every new order.
1.3 94 Wines uses these personal data (i) to verify the correctness of the data with respect to the compulsory age limit and to fulfill your order, (ii) to contact you regarding the fulfillment of your order.
1.4 Furthermore, 94 Wines uses your personal data to improve the services and products that 94 Wines offers. In this way 94 Wines can be fine-tuned to your wishes and needs.
1.5 When you upload a data file like a photo, film or text, in order to have this file attached to a bottle by a QR code, this file will be used by 94 Wines to fulfill your order and to make this file available to the recipient of the specific bottle with the QR code.
1.6 We record the IP-addresses of all visitors of our Website in order to determine from which computers 94 Wines is visited. This is done for the protection against improper use such as ‘hack’-attempts. In some cases IP-addresses will be denied access to the 94 Wines website. This will only occur following a violation of the rules as stated in the Conditions.
1.7 94 Wines will apply its utmost efforts for the correct manual application of QR codes and orders. If a wrong combination is made, despite these efforts, 94 Wines will fix this mistake by fulfilling the order again directly upon your complaint and return of the first delivery to 94 Wines; other obligations or liabilities are excluded by 94 Wines.
2. No sale to third parties
2.1 Under no circumstances 94 Wines will provide data of its Members (such as address, E-mail address or other personal data) to third parties without informing its Members about it beforehand;
3 No spam
3.1 Of course 94 Wines shall not trouble its Members with spam. In your 94 Wines account you can indicate if you wish to receive the newsletter. 3.2 If so indicated at your profile, you will receive the 94 Wines newsletter once a week. Furthermore, if you have indicated this at your profile, you may receive E-mails about entered interests.
3.2 After you have made a 94 Wines account you automatically will receive an E-mail in order to activate your account. When you apply with an existing account, such as Face book or Hyves, no mail will be send and 94 Wines will use your information directly out of your existing account. Besides that, Members can send E-mails to each other, to invite them as a ‘friend’. You are unable to opt out of receiving these E-mails in your account, because they are part of the core activities of a Member.
3.3 A Member can always op out of the newsletter and E-mails based on entered interests. This can be done by choosing ‘unsubscribe ‘at the bottom of the newsletter or E-mail. You will be removed immediately from the mailing database.
3.4 In every communication 94 Wines will point out the possibility to access, change or remove data concerned.
4. Inspection and alteration
4.1 You can always access or – if necessary – change your own personal data in your 94 Wines account. If you would like to know what data we have recorded about you and/or you would like to change it or have it removed, you can contact us through admin@94wines.com. When an account is removed, all the received and sent QR codes will also be removed from our database. This means that access to these files is no longer possible.
5. Third parties
5.1 If you use an existing account such as Face book or Hyves to create a 94 Wines account, 94 Wines cannot be held responsible, and the privacy policy of the third party concerned applies. Therefore, read the privacy statement or general terms of the website where you hold the existing account.
6. Use of Cookies and Visitors registration
6.1 Cookies are small text files, which are saved on your hard disk or in the memory of your computer. 94 Wines uses cookies to record the preferences you have entered. Basically, cookies cannot damage your computer or the files on your computer. If you do not want to accept cookies you can indicate so in your browser, but it is possible that some features of the Website will not work properly without cookies.
6.2 94 Wines also registers the IP addresses of all visitors of the website. These records will be saved for one year, which enables 94 Wines to verify the validity of the access to the QR files.
7. Other
